Fueltime User Privacy Policy

This Privacy Policy (the "Policy") explains our practices regarding the collection, use and disclosure of information that we receive through our service(s), website(s), mobile application(s), and any other online or products or services offered by Fueltime, Inc. or its affiliates or subsidiaries (collectively referred to as our "Services"). This Policy does not apply to any third-party websites, Services or applications, even if they are accessible through our Services. Also, please note that, unless we define a term in this Policy, all capitalized terms used in this Policy have the same meanings as in our Terms of Use. You confirm that you have read and understand this our Terms of Use by using the Services.
1. Revisions to this Policy

We may update our Policy from time to time. We will notify you of any changes by posting the new Policy on this page. We will let you know via e-mail and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective as of" date at the top of this Policy. You are advised to review this Policy periodically for any changes. Changes to this Policy are effective when they are posted on this page.
2. Information Collected or Received from You

a) Account Information. If you create an account, we will collect certain information that can be used to identify you, such as your name, email address, postal address and phone number ("personally identifying information" or "PII").

b) Information Collected Using Cookies and other Web Technologies. Like many website owners and operators, we use automated data collection tools such as Cookies and Pixel Tags to collect certain information.

"Cookies" are small text files that are placed on your device by a web server when you access our Services. We may use both session Cookies and persistent Cookies to identify that you have logged in to the Services and to tell us how and when you interact with our Services. We may also use Cookies to monitor aggregate usage and web traffic routing on our Services and to customize and improve our Services. Unlike persistent Cookies, session Cookies are deleted when you log off from the Services and close your browser. Although most browsers automatically accept Cookies, you can change your browser options to stop automatically accepting Cookies or to prompt you before accepting Cookies. Please note, however, that if you do not accept Cookies, you may not be able to access all portions or features of the Services. Some third-party Services providers that we engage (including third-party advertisers) may also place their own Cookies on your device. Note that this Policy covers only our use of Cookies and does not include use of Cookies by such third parties.

"Pixel Tags" (also known as web bugs, web beacons or clear GIFs) are tiny graphics with a unique identifier that may be included on our Services for several purposes, including without limitation to deliver or communicate with Cookies, to track and measure the performance of our Services, to monitor how many visitors view our Services, and to monitor the effectiveness of our advertising. Unlike Cookies, which are stored on the device, Pixel Tags are typically embedded invisibly on web pages (or in an e-mail).

"Log Data" means certain information about how a person uses our Services, including both account holders and non-account holders (either, a "User"). Log Data may include information such as a User's Internet Protocol (IP) address, browser type, operating system, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search terms, the links on our Services that a User clicked on and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize and enhance our Services by expanding their features and functionality and tailoring them to our Users' needs and preferences. We may use a person's IP address to generate aggregate, non-identifying information about how our Services are used.

c) Information Sent by Your Mobile Device. We collect certain information that your mobile device sends when you use our Services, like a device identifier, user settings and the operating system of your device, as well as information about your use of our Services. If you permit the Fueltime app to access the address book on your device through the permission system used by your mobile platform, we may access and store names and contact information from your address book to facilitate social interactions through our Service and for other purposes described in this Policy or at the time of consent or collection. In connection with facilitating the Services between you and the delivery driver, we may receive call data, including the date and time of the call or SMS message, the parties' phone numbers, and the content of the SMS message.

d) Location Information. When you use our Service(s), we may collect and store information about your location by converting your IP address into a rough geo-location or by accessing your mobile device's GPS coordinates or coarse location if you enable location Services on your device (or by asking you to input such information directly). We may also collect the precise location of your device when the app is running in the foreground or background. We may use location information to improve and personalize our Services for you. If you do not want us to collect location information, you may disable that feature on your mobile device, but the functionality of the Services may be impaired.

e) Transaction Information. We collect transaction details related to your use of our Service, including the type of service requested, date and time the service was provided, amount charged, and other related transaction details. Additionally, if someone uses your promo code, we may associate your name with that person.

f) Payment Information. If you choose to link, create, or log in to your Fuel Valet account with a payment provider (e.g., Google Wallet) or social media service (e.g., Facebook), we may receive information about you or your connections from that site or app. If your employer uses one of our enterprise solutions, we may receive information about you from your employer.
3. Information that We Share with Third Parties

We will not share any PII that we have collected from or regarding you except as described below:

a) Information Shared with Our Services Providers. We may engage third-party service providers to work with us to administer and provide the Services. These third-party service providers have access to your PII only for the purpose of performing Services on our behalf. We may share your PII and any necessary payment information, such as credit card number, expiration date and billing address, with our payment processing Services providers in order to complete transactions that are initiated through the Services.

b) Information Shared with other Third Parties. We may share anonymized or aggregated data we collect from the use of the Services, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access the Services, market trends and other analysis that we create based on the information we receive from you and other users. We may also share Log Data information collected via Cookies, Web Beacons, and Log Data with our attribution and remarketing providers.

c) Information Shared with Web Analytics and/or Advertising Services Providers. We may allow others to provide audience measurement and analytics service for us, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, pixel tags, SDKs, and other technologies to identify your device when you visit our site and use our Services, as well as when you visit other online sites and services.


d) Social Media. We may use certain tools offered by Facebook, Inc. ("Facebook") that enable it to collect or receive information about actions users take on:

  • our Site and elsewhere on the internet through use of Cookies, Pixel Tags and other storage technologies; or
  • our Mobile Application and other mobile applications, in order to provide measurement Services, targeted ads and other services. For more information regarding the collection and use of such information by Facebook, please refer to the Facebook Data Policy.

e) Information Disclosed in Connection with Business Transactions. Information that we collect from our users, including PII, is considered to be a business asset. Thus, if we are acquired by a third party as a result of a transaction such as a merger, acquisition or asset sale or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your PII, may be disclosed or transferred to a third party acquirer in connection with the transaction.


f) Information Disclosed for Our Protection and the Protection of Others. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate:

  • to respond to claims, legal process (including subpoenas);
  • to protect our property, rights and safety and the property, rights and safety of a third party or the public in general; and
  • to stop any activity that we consider illegal, unethical or legally actionable activity.
e) Your Options. Your options regarding these uses vary, but include:

  • Account information. You may correct your account information at any time by logging into your online or in-app account. If you wish to cancel your account, please email us at info@fueltime.co. Please note that in some cases we may retain certain information about you as required by law, or for legitimate business purposes to the extent permitted by law. For instance, if you have a standing credit or debt on your account, or if we believe you have committed fraud or violated our Terms of Use, we may seek to resolve the issue before deleting your information.
  • Access Rights. Fueltime will comply with an individual's requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.
  • Location Information. If you initially permit the collection of this information, you can later disable it by changing the location settings on your mobile device. However, this will limit your ability to use certain features of our Service. Additionally, disabling our app's collection of precise location from your device will not limit our ability to collect your trip location information from a Driver's device, nor our ability to derive the approximate location from your IP address.
  • Contact Information. You may have the option to opt out of transmitting contact information depending upon and subject to the abilities and authorizations of your mobile operating platform.
  • Promotional Communications. You may opt out of receiving promotional messages from us by following the instructions in those messages. If you opt out, we may still send you non-promotional communications, such as those about your account, about Services you have requested, or our ongoing business relations.
4. Responding to Do Not Track Signals

Our Site does not have the capability to respond to "Do Not Track" signals received from various web browsers.
5. The Security of Your Information

We take reasonable administrative, physical and electronic measures designed to protect the information that we collect from or about you (including your PII) from unauthorized access, use or disclosure. When you enter sensitive information on our forms, we encrypt this data using SSL or other technologies. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.
6. Links to Other Sites

Our Services may contain links to websites and services that are owned or operated by third parties (each, a "Third-Party Service"). Any information that you provide on or to a Third-Party Service or that is collected by a Third-Party Service is provided directly to the owner or operator of the Third-Party Service and is subject to the owner's or operator's Policy. Fueltime is not responsible for the content, privacy or security practices and policies of any Third-Party Service. To protect your information, we recommend that you carefully review the privacy policies of all Third-Party Services that you access.
6. Links to Other Sites

Our Services may contain links to websites and services that are owned or operated by third parties (each, a "Third-Party Service"). Any information that you provide on or to a Third-Party Service or that is collected by a Third-Party Service is provided directly to the owner or operator of the Third-Party Service and is subject to the owner's or operator's Policy. Fueltime is not responsible for the content, privacy or security practices and policies of any Third-Party Service. To protect your information, we recommend that you carefully review the privacy policies of all Third-Party Services that you access.
7. International Transfer

Your PII may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide your PII to us, we may transfer your PII to the United States and process it there.
8. Rights of Access, Rectification, Erasure, and Restriction

If you live in the European Union you may inquire as to whether we are processing any of personal information about you, and request access to, correction, or deletion of your personal information. To contact us, please e-mail us at info@fueltime.co. Please include your full name, email address associated with your account, and a detailed description of your data request.

Although we will make a good faith effort to comply with your request, there may be circumstances when we are unable to do so, such as when the information contains legal privilege or is subject to a legal obligation to retain it, would compromise others' privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the individual's privacy or where it is commercially proprietary. To protect your privacy, we will take commercially reasonable steps to verify your identity before granting access to or making any changes to your PII.
9. Child-information Policy

Our Services are not directed to children under 13 and we do not knowingly collect PII from children under 13. If we learn that we have collected PII of a child under 13 we will take steps to delete such information from our files as soon as possible.
10. Your California Privacy Rights

California residents may request and obtain from us, once a year, free of charge, a list of third parties, if any, to which we disclosed their PII for direct marketing purposes during the preceding calendar year and the categories of PII shared with those third parties.
